IIO Reaches Decision in Motor Vehicle Incident in the Town of Mill Bay (IIO 2018-072)

Surrey – The Chief Civilian Director (CCD) of the Independent Investigations Office of B.C. has reached a decision in the June 17, 2018 fatal motor vehicle incident in the Town of Mill Bay.

Based on a review of all of the evidence collected during the course of the investigation and the relevant law, the CCD has found that the officer did not cause or contribute to the death of the male rider. Evidence indicates that the officer was not involved in the initial motor vehicle incident, arriving moments after it occurred. The officer then, even though off-duty, and acting in a dangerous situation, provided first aid assistance to the injured male which unfortunately was unsuccessful given the significant injuries the male had suffered. At the same time, the officer repeatedly sought to prevent injury to a civilian witness.

Therefore, the matter will not be referred to Crown Counsel for consideration of charges.

Due to the concurrent investigation by police, the IIO will not be issuing its usual public report in this case, pending the conclusion of the matter.

Background

The IIO is the independent civilian oversight agency of the police in British Columbia. It investigates all officer-related incidents that result in serious harm or death, whether or not there is any allegation of wrongdoing.
