Surrey – The Independent Investigations Office of B.C. has filed a Supreme Court petition in relation to the IIO’s investigation into the death of Myles Gray. The petition seeks an order for a Vancouver police officer to cooperate fully with the investigation by attending for interview as directed.
Mr. Gray died following an altercation with Vancouver Police Department officers on August 13, 2015 in the 8300 block of Joffre Avenue. The IIO has been investigating this case since then.
A witness officer, who has a duty under the Police Act to cooperate fully with the IIO, has refused to attend for a second interview.
Witness officers’ statements are critical in ensuring the IIO receives all the facts. In this case, the officer, through her legal counsel, is imposing conditions on the IIO prior to a second interview. The IIO does not agree to those conditions. As a result, the IIO is seeking the assistance of the Court to resolve this matter.
